UNFAIR/WRONGFUL DISMISSAL CLAIMS

A claim for unfair/wrongful dismissal usually takes around 12-18 months from issuing the claim form to the final hearing at the Employment Tribunal.

The first stage of the process is to prepare and issue the claim. Following receipt of the defense, witness statements and a schedule of loss is prepared and documents are exchanged by the parties.

It is possible that settlement may be reached without attending the Employment Tribunal, however if no settlement is reached, the final stage in the process is a tribunal hearing.

Our charges for representing you are based on an hourly rate of £272.00 plus VAT (at 20% or the prevailing rate if different)

The average cost of a claim which progresses to a tribunal hearing is between £5,000.00 – £10,000.00 (plus VAT at 20% or the prevailing rate if different) depending on the value and complexity of the case.

If your case goes to the Employment Tribunal it will be necessary to instruct a barrister to represent you. Barrister’s charges are likely to be in the region of £1,250.00 per day. Most barristers charge VAT (at 20% or the prevailing rate if different).

SETTLEMENT AGREEMENTS

A settlement agreement (sometimes known as a compromise or severance agreement) is a binding agreement setting out the terms on which your employment with your current employer is to end.

A settlement agreement may be offered by an employer to avoid formal redundancies or to end a dispute.

Employees are not obliged to sign a settlement agreement and careful consideration needs to be given to the terms of the agreement as the settlement agreement prohibits the employee from making any claims against the employer.
